But, contrary to what Breyer wrote, nowhere in the Constitution does it say that the Federal Government has power over state prisons. This decision is consistent with earlier decisions whereby the Supreme Court assumed power over state prisons. If the SC can control state prisons, I suppose it makes sense that Congress canb also do so.
