		<description>I agree that Congress has the power to enact laws necessary and proper to fulfill its Constitutional function.  But, contrary to what Breyer wrote, nowhere in the Constitution does it say that the Federal Government has power over state prisons.  This decision is consistent with earlier decisions whereby the Supreme Court assumed power over state prisons.  If the SC can control state prisons, I suppose it makes sense that Congress canb also do so.  The result is an ever more powerful Federal government</description>
